Terms and Conditions of Use for Masafood Services by Users

Preamble

These Terms and Conditions constitute the agreement between you and Masafoods ("we," "us," "Company," etc.).

By visiting or using our Website, you agree to and are bound by these terms. Partnering stores (sellers) may impose additional terms and conditions, which you also agree to and are bound by.

Masafoods is the trade name of the company named “MASA FOODS MONOPROSOPI I.K.E,” registered with the Greek General Commercial Registry (GEMI) under No. 168385720000 and VAT ID 802025274, headquartered in Greece (10 Navarchou Kodrigkton Angelou Street, Rhodes 85100, Greece).

By using our Services, you agree to these Terms. If you do not wish to accept these terms, you may leave our Application/Website and cease using the Masafoods platform.

Upon registering on the Masafood Website or App, we may use your contact details to send informational emails in compliance with Law 4624/2019, the decisions and guidelines of the Greek Data Protection Authority, and the General Data Protection Regulation (GDPR) – Regulation (EU) 2016/679. • "Masa App": The mobile application software allowing you to select, order, and pay for products or services. This includes any "application" or other materials provided under license by us, including support networks in physical or electronic format.
• "Service": The services provided via the Masafood App/Website.
• "Content": Text, visual or audio content available as part of the Masafood App/Website, including content posted by you or vendors for promotional purposes.
• "Copy or Publish": Reproduction or distribution of the Masafood App/Website in any medium, including modifications or usage as part of other software.
• "Device": Any electronic device used to access the Masafood platform.
• "License": The license granted by us under these Terms for using the Masafood App/Website.
• "Our Website": Any website or service owned or operated by us designed for online access.
• "Publication": Posting any material on our Website using any medium.
• "Product": Any product offered for sale on our Website via any medium.
• "Seller": An individual or organization whose products are sold via the Masafood App/Website.
• "Software": The software supporting the functionality of the Masafood App/Website.

General Terms of Use

1. Service Availability: Our services are not available in all countries. We may refuse service to users in unsupported regions.
2. License: Users are granted a non-exclusive, non-transferable, personal, limited license to access and use the Masafood platform, provided they adhere to these Terms.
3. Third-Party Dependencies: The availability of the Masafood App depends on third-party providers (e.g., Apple App Store, Google Play). This agreement concerns only the User and the Company, not the app store provider.
4. User Representations: By using the platform, Users agree they rely solely on the terms and service descriptions provided on our Website.
5. Non-Transferable Rights: Users may not transfer or assign their rights or obligations under these Terms.

Account Creation

1. To use Masafood services, Users must create an account by providing valid personal details (e.g., email, phone number, password).
2. Users are responsible for maintaining the confidentiality of their passwords and for ensuring the accuracy of the information provided.

Platform Usage

1. By accepting these Terms, Users confirm they are at least 18 years old and fully understand these Terms.
2. Masafood acts as an intermediary between Users and partner stores, facilitating purchases and payments. The Company bears no further liability beyond this intermediary role.
3. Users can choose from a variety of products and services offered by partner stores. Delivery is handled either by the stores or Masafood, where applicable.
4. Feedback or complaints regarding vendors can be submitted via our platform. The Company reserves the right to take appropriate legal action at its discretion.
5. The Company is not responsible for product deliveries, returns, or refunds.
6. Users must resolve disputes with vendors directly, as the Company has no responsibility for the quality or type of products sold.

Account and Personal Data

1. Users are responsible for all actions performed using their account credentials and must notify the Company immediately if they suspect unauthorized use.
2. The Company is not liable for errors arising from inaccurate information provided by Users.
3. The Company reserves the right to restrict or delete accounts under certain circumstances (e.g., suspected unauthorized use or violation of Terms).

Restrictions on Use

The Company reserves the right to investigate and take legal action against any unauthorized or prohibited activities that undermine the platform's integrity, including:

1. Illegal use of the platform.
2. Posting defamatory, offensive, or unauthorized content.
3. Violations of intellectual property rights.
4. Spamming, cyberbullying, or posting malicious content.
5. Unauthorized data collection or use of third-party credentials.

The Company may take appropriate actions, including account suspension, to address such violations.
